    Default Can You Be Fired for Complaining About a Co-Worker on Facebook Without Using a Name

    An employee complained on Facebook that somebody she works with takes too much sick time off of work, that it puts a burden on other workers, and that anywhere else that worker would be fired. She did not name the person, or even name her employer. The employer called it harassment and fired her. Can she be fired even though she didn't name the co-worker or her employer, in Pennsylvania?

    In a word, yes. Absent a contract of employment, union contract, or civil service law that would prevent her from being fired, she's an at-will employee who can be fired for any reason that is not unlawful (e.g., race, sex, color, religion) at the whim of her employer. It's also apparent that people were able to figure out who she was complaining about, as her employer received a complaint and took action.

    Also, before complaining about a co-worker's sick time, it makes sense to consider that you may not be aware of their health issues and that they may be receiving legally protected leave for their own medical issues or those of a family member.
