    Default When Should You Sue for Criminal Conversation in North Carolina

    My question involves a marriage in the state of: North Carolina. We still observe AoA and Criminal conversation. My wife and I have been having issue for maybe a year in and off. She has never actually moved out. Although she has an apartment now and has only stayed there twice in 2 months, me the other. She had a relationship with a guy and they had sex during this period. She is pregnant by the man so there is no denial because we have not been intimate. No separation papers have been filed or divorce. She has spoke of divorce. She met this guy while we appeared to have a viable marriage. Celebrated anniversary and family vacation. It is unknown who made the move on who. She met him while staying at my family beach cottage without me.

    From what I know. He is a young guy who perhaps flunked out of college. His dad is a divorce lawyer and is well off as far as money. This guy lives in his dads apartment complex so I know of no dominates of him

    Do I have a case? Would I just be wasting my money for divorce leverage? I would like to this guy to pay for his doings because he knew of me and I even payed him a very respectful visit.

    Get divorced or not. Move on or not. Suing him won't bring you any satisfaction ... and it might bring her AND him satisfaction at seeing you so upset.

    You can't get any money from the father, just the son who actually had the affair with your wife. If he doesn't have much in assets then even if you got a sizable judgment against him that judgment might not do you much good unless sometime in the future the guy comes into money. And that will be after the child support he’ll have to pay for the child because the child support comes first. Note that while NC retains these causes of action, there is no guarantee a jury will award you much. A lot of people today take the view that when your spouse has an affair, it is your spouse’s fault for breaking the trust with you, not the person your spouse had the affair with. After all, it was your wife who had made a promise to be faithful to you, not her lover. Consult a NC attorney who handles these kinds of claims to discuss whether it might be worth pursuing.

    Would a judgement make his life harder until he paid something for it? I just want to be a pain in his rear like this has been for me.

    No.

    Are you asking to be miserable for the rest of your life? If you want to stay with your wife, then AoA is no longer an issue anyway.

    I want to stay with my wife. But realize if she doesn't want to be with me. That is how it's gonna be. I just want to make his life a little tougher. He is a spoiled kid that I believe has gotten his kicks off screwing an older woman and pissing her husband off. I would like to make it hard for him because he sure has made it hard for me.

    And yes. I do feel entitled to damages. My wife's income has been taken out of my family's equation and not to mention therapy.

    Because you're already obviously miserable and if you're to have any chance of changing that, you're going to have to change your mindset. Do you truly not understand how much of this isn't his fault at all? Do you not see that pursuing this is only going to give him an even bigger kick? Do you not see that in his mind, he'll be winning all over again? He made you no promises. Your wife, however, did.
