    Default How to Keep You Family From Finding Out That You Were Caught Shoplifting

    My question involves criminal law for the state of: Californa.

    So I was with a friend whom got caught for shoplifting at Khol's. We signed forms and can't go into there for 2 years, understandable. Yes we realize it was a bad idea etc.

    However the concern I have, seeing that I live at home with family, is if my family will find out. As well as if my family's membership with Khol's will be effected seeing that we share the same house/last name.

    From what I'm ASSUMING is that they can't do that seeing as that would be violating some kind of information thing? I don't quite know and I'm probably going to call corp. tomorrow to ask about it.

    I plan on paying off the demand seeing that I deserve it, but are there any other concerns I should have? I really don't want any family members to find out because it's quite embarrassing.

    If you are an adult, any civil demand will likely be addressed to you and not your family. If, however, you are a minor, then any civil demand will likely be addressed to one or both of your parents.

    And, yeah, they can look up your family's information at the business if they so choose. But, they probably would not need to, assuming you provided them with your correct name and contact information at the outset.

    I'm an adult, yes. However I don't want my family members account to be locked/banned for whatever reason because of my stupid actions. I've been worrying since it happened if my family member will have their account banned for whatever reason.

    Your family should not suffer any repercussions for YOUR actions. However, as a private company, they may be able to ban them if they wanted to, I just don't see it as a realistic option and have never heard of such a thing happening.

    This civil demand has absolutely nothing to do with criminal charges of petty theft or shoplifting. If there is any actual restitution, you’ll be required to pay that amount (not some inflated amount) through the Court.

    One thing though, if you contact the store or the law firm/collection agency seeking the money then they’ll know they’ve got you on the hook. By engaging with them in any way, either by phone or by mail), they will feel they have somebody who’s willing to pay them and they will keep up their efforts to collect from you.

    Cal. Penal Code 490.5(c) limits civil damages in shoplifting cases to $500. Are they entitled to the money? Probably not. Here is why, the store recovered the merchandise in undamaged condition and simply put it right back on the shelf to be resold. Their actual damages are almost always nothing. The store personnel involved in this situation were already on the clock, so no extra salary was paid to deal with you. Consequently, their actual damages are arguably zero.

    Either pay the amount demanded, if that gives you peace of mind, or ignore them completely. Paying off the demand is not an admission of guilt. The choice is yours.
