    What are a tenant's rights if a landlord won't pay to exterminate mice that are infesting your rental home, instead attempting to fix the problem himself, under California's landlord-tenant law? The mice were present when the tenant moved in. The landlord's traps and other efforts have reduced the number of mice but, four months later, there is still a significant mouse problem.

    Among the circumstances that violate a landlord's warranty of habitability, owed to a tenant, is the presence of rodents in the unit. Civil Code Sec. 1941 (A landlord must provide "Building, grounds, and appurtenances at the time of the commencement of the lease or rental agreement, and all areas under control of the landlord, kept in every part clean, sanitary, and free from all accumulations of debris, filth, rubbish, garbage, rodents, and vermin.")
