    Default What is a Motion to Vacate DWP

    In an Illinois divorce case, a wife received a "Motion to Vacate DWP" from her husband's lawyer. What is a DWP and what is the purpose of the motion?

    DWP means "Dismissed for Want of Prosecution" -- basically, if no action is taken on a case for a significant amount of time, the court may dismiss the case. A motion to vacate the DWP means that the lawyer is trying to get the court to reinstate the case, so that it can proceed.
