    Default Is it Legal to Hire Foreign Workers

    My question involves civil rights in the State of: California

    A friend of mine was interested in creating an organization that would hire and pay for transportation of labor from poverty stricken countries to the US. It would be a construction agency or something similar that would teach them skills and pay them minimum wage to work on houses. Take in mind that minimum wage in the US is far more than they make in a day in their countries. My question was if his idea is possible since he has to bring people from other countries to work for him. He is actually helping out these people by giving them a job and helping them learn new skills. Is it illegal to hire people to come to America and work for you? And does it make a difference if they are in extreme poverty? Is it wrong to pay them minimum wage even though it's way more than back home?

    Tell your ... "friend" ... to consult with an immigration attorney to guide you ... er "him" ... further.

    He is going to need a lawyer and it may still not be possible.

    But here is some basic info on the issue.

    P.S. This is not a "Civil Rights" issue.

    Yep, them being disadvantaged in their country is NOT justification for any work-related visa in the US. Teaching them skills is one thing, but employing them in the US isn't likely to happen. If he has altruistic ideals, he should train them to work in their own country.

    I'm going to answer your question literally.

    It is not inherently illegal to hire foreign workers, as long as they have an appropriate work visa, which must be issued by the US government.

    Ask yourself how likely it is that the current administration will willing issue a single work visa to a foreign worker if there is any possibility that a US worker can be found to do the same job.

    It really has little to do with the current administration. Trump is too preoccupied with appearance to study or act on the minutae of the immigration law. The underlying statutes just don't provide for this as a reason to bring in foreign workers. There are a handful of classifications in which foreign workers may enter to work, but this is not one of the ones that exist as far as I can tell.

    It's not. And it wouldn't be regardless of the administration. But I was attempting to make a point in terms that the OP might understand.

    If this person is anywhere older than a fifth grader, then the most cursory reading of any immigration or department of labor information should be enough to dispel these happy notions you can just go get a whole shipload of people in third world countries and "bring them over here" to work legally. I think they'll probably cover this in the sixth grade civics class, and this whole thing sounds SO hokey. It's kind of like there are people out there who assume there are no immigration/verification policies going on right now.

    I'm pretty sure this was made illegal in the US is the 1860s...right?

    A lot like the people who are convinced they can just move to Canada - and hey! get free health care too! - because they don't like Trump.
