    Default Can a Landlord Use Pictures of a Tenant's Apartment in a Real Estate Listing

    A landlord took pictures of a tenant's unit, claiming that they were needed for an appraisal. The tenant has since discovered that the landlord has listed the property for sale, and pictures of the tenant's unit appear in the ad, showing the tenant's personal property. Can the landlord use those pictures in the ad without the tenant's permission?

    The landlord may use photographs of the premises in a real estate listing, including interior shots of units. The tenant can certainly object to any depiction of the tenant or the tenant's family in the ad, but the incidental appearance of the tenant's personal property is not going to present a legal basis to prevent the use of the photos.

    If there is a specific reason why the tenant does not want a particular picture shown, the tenant can consider asking the landlord to take down the picture. Beyond that, without detailed facts, the best we can do is suggest that the tenant consult a lawyer with the details of the situation.
