    Default Do You Need a Divorce from a Possibly Bigamous Marriage

    My question involves a marriage in the state of: florida. My husband just told me he wants a divorce but said we are not legally married since he was still married to his 4th wife in 2003 when we were married. That he never legally divorced her until 2005. And I did some digging and found his divorce decree with our marriage license from 2003. What am I suppose to do? I am disabled and fighting for disability and he told me I am entitled to nothing not even alimony because we are not legally married.

    You need to hire a divorce lawyer now and don't wait to be served with his petition for divorce.

    Your husband is correct in that in Florida, if he was still legally married to another when he married you, the marriage is void. But that doesn't necessarily mean that you are entitled to nothing. The courts have discretion in these matters and it was your husband that acted in bad faith.

    So calm down and go find an attorney.

    Get a lawyer and proceed with a divorce or an annulment. Even if the marriage is found to have been void, you can expect that the court will handle property division and spousal support as if the marriage was valid. See, e.g., Kindle v. Kindle, 629 So.2d 176 (Fla. 5th DCA 1993) (putative wife of a twenty-year marriage was entitled to permanent alimony following annulment where the putative wife was not aware that her husband was already married at the time of their purported marriage).

    He married me in 2003 and his divorce to the other woman was finalized in 2005
