    Default Do You Lose Your Rights to a Share of the Marital House if You Move Out

    If a married couple in Texas owns a house, and one moves out and files for divorce, will the spouse who moved out lose her right to a share of the marital house, or get a reduced share?

    For a divorce that follows quickly from separation, there should not be an effect on how the marital estate (including the home) is ultimately divided. If there is a long separation, then equitable considerations may arise that could cause a court to adjust the division, but that would not be an issue under the described facts.
