Illinois:

Felony Fleeing and Eluding. No priors, not even a speeding ticket. Great academic and work history, 24y/o.

I was driving in the middle of farmland on a sunday evening at sunset, near empty roads. I was later arrested for Felony Fleeing and Eluding due to allegedly 20mph over speed limit. It took 3.5 months to get the video and police reports. After viewing the video there was a dark brown police car sitting halfway off the road in oncoming traffic with no markings from head on and only dark gold/brown "Sheriff" written on the side. He turned on lights less than a second before I passed him and it took him 10 seconds to turn around and approx. another 9 seconds 0-60. By the time he turned around I was out of sight, let alone another 9 seconds 0-60mph.

I never saw lights, or even a police car, and he didn't activate sirens. I was driving into the sunset which may have played a factor other than the obvious of not seeing the lights 30ft in front of my car when Im looking a half mile down the road.

None of the GPS data or Radar data was recorded on his dash cam although the other 2 police car videos they released (ones driving to the scene) had operable data recording on their dash cam.

I never saw lights or a police car, but the law even states you can pass a police car with lights on in oncoming traffic and continue on your way. I don't get how this is happening to me. Really crazy.

I have hired a lawyer after interviewing about 15, but he is pretty distant and doesnt seem aggressive. Although, I know they're busy with others too.

Is there a law that states how close behind you a police officer has to be to pull you over?! It seems crazy to think Id see lights in my rear view mirror when the officer looking forward even near-immediately lost sight of me. I have a couple friends who are cops and they said they regularly have to turn on sirens, not just lights, to get the attention of people even just 15ft behind them. They said the case is weak, however, the county that this happened in has a really really bad reputation.
