    Default Can I Switch Vendors but Work for the Same Client

    My question involves labor and employment law for the state of: California
    Can i switch vendors but work for the same client? My current vendor is threatening legal action if i do so, i do have a non- compete.
    I am willing to take a 30 day break in service if i need to as a courtesy.

    Depends what your non-solicitation agreement says. Also depends on what agreements your vendors and the client have in place.

    Switch vendors and work for the same client?

    you either work for a given employer or as an independent contractor. It sounds like you work for a temp service or provider of labor assigned to some particular client and want to work for a different service for the same client.

    The agency that placed ylu is likely likely to have an action against the client if I am describing the situation somewhat correctly. Most labor agencies have contracts with their clients that the client will not circumvent the agency/employee relationship without risk of penalty.

    my vendor and client do not have any agreement in place, they say as long as i take a break in service which i am taking.

    They obviously have some contract in place or you would not be working at the clients business and being paid by the agency.

    They're OK with it if you take a break in service yet are threatening to sue you?

    the client says if i take a break in service and come back with someone else they will be fine with it.
    My vendor is threatening legal action. They know i am not from the states so i feel like he is trying to scare me into staying but the research ive done indicates that if i take a break in service and come back under a new role/ work order i will be fine?

    This is not a matter that is governed by law. This is a matter that is governed by contract. And we can't read your contract, or the contracts between the vendor and the client, from here.
