    Default Are SSDI Overpayments Dischargeable in Bankruptcy

    If the Social Security Administration determines that you have been overpaid in the amount of your SSDI benefits, and you have lost your appeals, is their claim for reimbursement dischargeable in bankruptcy?

    SSDI overpayments are normally treated like an unsecured debt in bankruptcy, meaning that they are dischargeable. The SSA may object to discharge if they take the position that the benefits were obtained by fraud.
