    Default Immigration Options for the Sibling of a U.S. Citizen

    An F1 student, presently studying in the U.S.A., has a U.S. citizen sister who has filed an I-130 for him. However, the amount of time until his priority date comes up is many years away. Is there a different priority category that applies to people who are already in the United States, or any other way to speed up the process?

    There is only one category for siblings, whether or not the sibling is in the United States.

    The sibling will have to either find a way to maintain legal status in the U.S., such as by continuing with F1 studies, F1 OPT, or trying to get a H1B visa after his studies are complete or, if that's not possible or the sibling does not want to take that path, will have to return home and later seek consular processing when his priority date arrives. If he marries a U.S. citizen, that will provide a different (and faster) avenue to LPR status.
