RE: California seal & destroy arrests and expunge convictions
Just got my DOJ.
1. RE: Petition to Seal and Destroy:
20+ years ago, DOJ record shows 148 resist public officer arrest/cite (that I didn't get) but doesn't show the cites I did get for reckless driving and DUI. Reckless not filed. I pled nolo to DUI, paid a fine. Was never cited for resist officer. If I ask DOJ to correct this error, will they study the record (is there still a record anywhere?) and add back the reckless cite and DUI conviction? And make my record worse? Should I not write DOJ and instead fiile a petition to seal and destroy with the county D.A. and police dept? Will they find the record and add back the reckless cite and the DUI conviction? Should I do nothing about this as a best option? I've read DOJ keeps all resist officer cites forever, maybe this is the explanation.
2. RE: Expungement of a different misdemeanor from almost 20 years ago. Does LA County Court pull my DOJ record when they decide about expungement? Do I have to file a copy of the petition for expungement on the DA? Will the DA pull my DOJ record?
3. RE: CA Real Estate License. Does anyone know if Dept. of RE pulls DOJ record in licensing?
