    Default What are the Consequences of Violating Unsupervised Bench Probation

    A defendant in Washington was placed on three years of unsupervised bench probation following a DUI conviction. The driver is more than two years into his probation, and has just received another DUI in Oregon, with a high blood alcohol level. What could happen in the Washington case?

    The consequences of violating unsupervised probation are the same as with any form of probation -- you can be resentenced, and could potentially serve all of the remaining jail time on the underlying conviction. You could also face other consequences, such as a shorter amount of time in jail, extension of probation, being placed on supervised probation, and the like, or some combination of consequences. It's best to discuss a probation violation with a criminal defense lawyer.
