    Default Speeding ticket deferral in Whatcom county, Washington

    I was pulled over in Whatcom county for driving 78 in a 60 zone a few days back. Now I am back in California. I called the county court. The clerk told me I can write a letter to ask for administravtive deferral so this ticket won't go into my driving record. The clerk also told me there is a $150 fee for the deferral. I was wondering how I can write this letter. Are there any website with detailed instrution for the deferral? Is there a template I can use. Should I include the ticket and a check with the letter? Or wait until the deferral has been granted?

    Any info will be appreciated.

    Use Google to see if you can find any example letters. I don't know of any official resource. Ask the court clerk if you should include the ticket and payment with your letter.

    In WA, you have 15 days to respond to the citation. THIS IS CRITICAL!!! It doesn't matter what your plan is, you must first respond. If I were you and wanted a deferral, I'd check "Guilty with an explanation", make a copy of the citation, and mail the original. You will then receive a hearing notice. At that time, call the clerk of the court again and ask your questions. Be polite and respectful. Most clerks I've encountered are very helpful.

    Basically, what you'll be doing is having a "mitigation hearing" on written statements (IRLJ 3.5(b) permits this). In addition to asking for deferred findings, I would include any reasonable explanation (if you have a clean record in CA, you might want to include that fact) for the speeding. That way, even if the judge turns down the request for deferring findings, he/she may reduce your fine.

    Wow, $150. Up here in King County, most deferrals are only $100. I've heard about $125, but this is the first time it's reached $150.
