    Question Can a Landlord Evict You if They Know You Have Moved Out

    My question involves landlord-tenant law in the State of : Arkansas
    I had a death in the family so l was gone but my son went to start packing for me and to let the landlord know that l was moving l went myself finished packing and moving it all out and the landlord seen us doing all of this and 3 days later a friend of mine was passing by there and seen a note on the door she got it and it was a note from the sheriffs office of an eviction how or way after knowing and seeing me move can l be given a eviction lam on social security l don't get that much to live on it took all l had to move lve not seen the eviction notice yet l want to since he was informed of the move before rent was due and l moved do l still have to pay the rent

    You were served with a notice to quit for what? Failure to pay rent? Abandoning the unit? Something else?

    You should try to negotiate terms for your departure with your landlord.

    Did you have a lease and broke it by moving out owing rent?

    Even without a lease you have to provide ample notice (typically a 30 day WRITTEN notice) that you will be terminating this month to month tenancy. You can't simply up and take off after calling and saying I'm moving.

    I agree entirely but is an eviction the proper solution for a landlord when someone leaves without the proper written notice? That seems counter intuitive. I would have thought that a lawsuit for unpaid rent either through the notice period, or the lease period, or the finding of a new tenant, whichever appropriate, would have been the more suitable solution.

    Just speculating since we don't know exactly what the "note" said.

    The "eviction" may be nothing more than the landlord seeking a writ of possession so that he can re-enter and re-rent without any issues with the tenant possibly claiming continued tenancy or lost property.

    The "note" from the sheriff might only be confirmation of that.
