    Default How Can You Avoid Paying a Broker's Fee for an Apartment

    A prospective tenant went to a broker for help finding an apartment in New York, and signed a contract promising the broker a 15% fee. The tenant's favorite apartment is not listed through a broker and is available without paying a broker's fee. Is there a way for the tenant to rent that apartment without going through the broker so as to avoid paying the fee?

    I suspect that the contract is clear, and that the tenant is contractually liable to the broker for any apartment shown to the tenant by the broker. If the tenant tries to circumvent the agreement, the tenant can anticipate a collection action or lawsuit by the broker. If the tenant is intent on avoiding the payment, the tenant should have the contract reviewed by a lawyer.
