    Angry Guest Nightmare

    Me and 2 of my friends were moving into a house in New York in the middle of February. I needed to move in early so I moved in about a week early. Then my roomates didn't want to move in until they were able to move thier beds as well (one queen size, one waterbed), but they paid their rent so it didn't matter. About a week and ahalf after I moved in, my friend's friend came to him and cried that her boyfriend was beating her and she needed a place to stay, so we allowed her to stay in the small den we have off the back porch. Shortly after she moved in, she also moved her boyfriend in and shortly after that, she moved his son in as well, taking over the entire bottom floor of our house. She also told my other roomate that the landlord wanted the key back and collected his key. Then last night she threatened me for my key "I've gone to jail for slicing a b*tch before and I'm not going back so you better be gone before I get home." and told me I had to leave. I left just because I was afraid of being 'sliced' and called the landlord. She drove out to the house (from nearly 30 miles away) and told her she had to leave. The landlord took her key and escorted her out, but she came back after the landlord left and stood on my front lawn screaming that I owe her money until the neighbors called the police. The police told me I had to let her in and if I felt threatened than I should leave. This girl was only staying as a guest - as a FAVOR because she had no place to go. Only my name is on the lease, doesn't that give me any say as to who is in my house? Also, she found my copy of the lease and ripped it up - she thinks that voids it even though the landlord (who wants her out) has another copy. She told me today that she would put my stuff outside in the shed if I didn't pick it up by tonight. That is MY house! She cannot just come in my house and take over, can she? Help! This is giving me hypertension! I want her out NOW - before her and her druggie boyfriend do physical harm to me or my belongings or my house. I know I'm not supposed to just throw her stuff outside but the landlord took her key and I can't even go back to my own house while she's there. Can the police make me let her in? (Oh, and the landlord gave her back the part of the rent she paid so she would leave.)

    well, you let her in. she apparently paid rent. that makes her a tenant.

    whether you or your LL is her LL is the only question not answered.

    In either case, her LL must evict her according to the laws of New York.

    Given that she is threatening you, look into the possibility of getting a personal protection order. Having her legally barred from being within 100 yards of you, for example, would likely be a fast way to get her out of the house.

    If you can, when she threatens you have a friend be there as a witness then call the police. She may have a right to stay there but she has no right to threaten bodily injury.
