    Default Can You File a Joint Bankruptcy After Separating From Your Spouse

    If you separate from your spouse, and now both still live in separate cities, can you still file a joint bankruptcy? No divorce has been filed.

    Yes, it is possible -- although under those facts it would be sensible to work with a bankruptcy lawyer.

    If this could end up being a Chapter 13 bankruptcy, the lawyer will likely advise divorcing before the bankruptcy, as divorcing during a Chapter 13 repayment plan can create a lot of complexity. If this is a Chapter 7 bankruptcy, although the parties would still want to avoid divorcing during the bankruptcy, it's a much shorter process.
