    In some circumstances, yes, it really does; in fact, given that he works for a hospital, I'm guessing that the law is the one requiring that he get the flu shot. I know we were required to get them when I worked for the bio-lab and I had nothing to do with the lab work; I was upstairs in the HR office. But that didn't matter; I was located in the building with the laboratory, I was required to get the shot, and we had to sign the waiver of liability. I am in a different state than the poster but I can't imagine state law in this matter varies all that much.

    I'll second cbg on this one. My current employment requires me to also work at a University hospital, and I was compelled to accept a series of shots as well as having to sign similar waivers. If I refused, I may have lost my job ... or, at the very least, I would have had some serious restrictions placed on my employment (such as wearing a mask and/or gloves when in the hospital and anywhere near staff or patients).

    The employer can do that because there is no law that prohibits the employer from doing it. Whether the waiver the employee signs is actually any good in protecting the employer is another matter, and without reading the exact waiver and knowing the exact circmstances surrounding the execution of the waiver I couldn’t say how likely it is that the waiver would hold up.

    I'm willing to bet the hospital's attorneys have already vetted any waivers, and this is not the shot giving staffs' first time at this rodeo. And, unless you are a contractor with a contractor for the hospital, you have PTO and insurance.

    I work within a hospital system in Alabama, not directly in patient care. However, we were told that if we did not take the shot, we would have to wear masks if we went into patient rooms. I'm pretty sure everyone in my group did so.

    That doesn’t mean the waivers are enforceable. Believe me, even if the hospital did run it by their lawyers it is not a gurantee the waivers will hold up. I have some experience on challenging waivers that employers have employees sign in situations not unlike this where ultimately the waiver was determined to be ineffective. There are several ways that the waiver might end up not being good, which is why the details matter.
