    Default Can You Move Out Early if Your Landlord Gives You Notice

    If your landlord gives you a month's notice, terminating your tenancy, do you have to pay rent for the full month, or can you move out earlier and pay prorated rent only for the days you remain in occupation, in Texas.

    Either party in Texas may terminate on one month's notice. If your landlord gives you longer notice (six weeks, two month, etc.) on a month-to-month tenancy then you can counter with your one-month notice (unless modified by the lease), but you cannot give notice shorter than a month -- so if you move out early, you would still owe rent through the end of the landlord's one month notice period.
