    Default Verizon Wireless Dispute

    Verizon Wireless recently raised their text-messaging rates as of March 1, 2007. Under their own Customer Agreement and the contract that I signed, any changes made that "adversely affect" me allow me to get out of my contract without paying an Early Termination Fee. I spoke with a CS Representative and also a supervisor and they denied my "request" to have the ETF waived. It isn't a request, it's my legal right under their contract.

    If Verizon sends this to collections because I don't pay, can I take them to court and sue them for it? Can I collect any other damages? I don't want to take them to court and leave owing $0 and not getting anything in return, I shouldn't even have to pay it to begin with. They should have to pay me something in return for my hassle.

    you can always try. it all depends on if the judge agrees with you or them.

    Per my previous post, I decided to cancel my Verizon contract without Early Termination Fee because of their rate-hike in text messaging. Verizon Wireless did not grant my "request" even though it is my legal right to do so based on their customer agreement, so I filed a complaint with the BBB. The BBB investigated the complaint and now Verizon has agreed to not charge me the ETF and to zero out my outstanding balance with them. Now this only happened after I spent a least 1-2hrs on the phone with Verizon Customer service and also taking other time out of day to file a complaint with the BBB. Should I just take it this resolution as it is or can I seek punitive damages from Verizon for the time and hassle they have caused me by not honoring their own Customer Agreement and Contract? If so, any estimate on how much I could collect? Would it be worth my time? I'm just sick of these companies bullying people around and they need to be taught a lesson.
