I have a cousin who is foolishy in Missouri. With a probation violation warrant or bench warrant, don't know for sure. I know he's on probation for id theft. he's living a legitimate life, i hope. Don't know why he left NY to go to missouri, think he just couldn't live in NY and decided to take his chances outside of NY.
he's been contemplating to save up funds to hire a really good attorney, so when and if he returns to NY; he can be properly represented.
first conviction, no prior arrests. Warrant is almost a YEAR old, probation started in August 2005. He could have applied for conditional release after aug 2007, since in NY you are eligible for conditional release for good behavior after two years of probation. BUT i'm sure he's no longer eligible for this.
He's paying taxes, personally; runs a little business, so he's doing ok. his crime was basically done as a favor for a friend who backstabbed him at the end. I believe it was a D felony. 5 YRs probation. they didn't even require him to make weekly visits to probation, just mail some form and call every month. So I guess he forgot to mail it or whatever, idk.
so the scenario is this, would NY extradite him on a probation violation warrant? if they find him.
And when and if he does return to NY, what could he be facing? and what can be done?
