My question involves a traffic ticket from the state of: California
I need help to correct HAZMAT that is incorrectly marked by CHP officer when I got a speeding ticket on my personal minivan. Unfortunately the CHP officer incorrectly marked HAZMAT and I failed to notice it on the citation.
1. Dec 2015: Speeding citation.
Hazmat - YES
Correctable Violation - NO - VC22349(a) Exceeding 65 MPH maximum speed - Infraction YES
2. Feb 2016: Feed paid and completed traffic school online
The Court letter had an option to attend traffic school online, so I paid the fee and cleared traffic school.
3. Nov 2016: Points shown on Driving record
Renewed auto-insurance and found that violation point is still shown on the record. It is 1.5 points.
4. Dec 2016: Filed DL-207 (returned in Jan), 20 phone calls to DMV and Court.
DMV said I should pursue with the court to correct/amend. Court said the case is closed. They asked to deal with DMV or CHP.
5. Jan 2017: Filed N400 and failed to mark "been cited" as YES.
Application is accepted and waiting for biometrics.
Is there a way I can pursue correction on citation, and get the points off my DMV record as I did not carry any HAZMAT? Please advise.
Please help. Anyone who had experience with same or similar situation, please let me know what are my options.
