    Default Can a New Lease Raise Your Security Deposit

    A tenant in Georgia has been presented with a new lease that raises her rent, and also requires that she pay an additional amount that it says will be added to the security deposit that she paid when she moved in five years ago, to make that amount equal to the current rate of rent. Can a landlord increase your security deposit after many years of tenancy?

    When renewing a lease, a landlord may impose additional security deposit requirements, as long as the total amount of the deposit does not exceed the state law limits based upon the current rate of rent. If the tenant does not agree to the proposed terms of renewal, the tenant's options are to negotiate for better terms or to give notice and move at the end of the current lease term.
