    Default Falsely Accused of SNAP (Food Stamp) Fraud

    My question involves criminal law for the state of: kentucky.
    I have been fighting a false charge for over 3 years now that is ruining my life in every aspect. In august of 2013, A woman who worked for the state became irate after i refused to falsify legal documents so she wouldnt loose her job and be criminaly charged. She went to her boss once i refused and began trumping up a felony foodstamp fraud case against me. I hired a very well known private attorney to help me out little did i know i was going to spend the next 3 years and still counting on a case that has never even been to pretrial.

    If that wasnt bad enough . In oct. 2014 when i got arrested i was booked under the wrong charges (felony cocain poss.) That did not get fixed until my husband contacted the jail and informed them of the mistake. I was also held for 4 days when i was supposed to be released on a signature bond that night. (first time ever being in trouble or in jail) then my first court apperence i was forced to plea no contest to a contempt of court charge and had to serve 7 days in jail, because of a false drug screen report (+thc) I informed my lawyer that it was wrong and the judge told me infront of everyone that it didnt matter because in his eyes i was guilty of felony fraud and he was going to put a stop to it in his town and make an example of me to everyone else.

    I tried to explain that i am a devoted mother of three who has been in recovery for over 4 years and that i did not participate in that type of lifestyle. It didnt matter that when i took my test in the court bathroom it didnt have any positive results but then all of suddon it magically changed to positive for tch.( was told to not make a big deal out of it or i would get more rime.) A few months later i recieved a letter from my employer staiting that i was a convicted felon. I contacted the DA and went to the court house to have a correction made. They acted like no big deal just a click of a box and no harm done. But i lost my job because of one of their mistakes!

    I was told by the DA he was going to drop the charges and help me fix my record back to having nothing on it and then next thing i know a new DA was brought on. He told me that if i wanted it to be dismissed than pay $3,000.00 in 3 months and it goes away. I told him "no "there is no evidence against me, i done everyhing right and have all the proof and i dont owe that city any money. I was then told the same thing i have heard since the begining, "its a political issue now and if i want it to go away than pay what they want." I later learned that my lawyer and the judge were close friends and that all of this was done to coverup the corrupt ways of that small town.

    My lawyer was supposed to have went to my last court date (sept 2016) and released himself so i could obtain a new lawyer and that i would be contacted with a new court date and there was no need in driving 2 hours. Later i was informed that a contempt of court warrant was issued instead of a continuance to obtain new council. I dont understand how i am even in contempt of court for doing what the court said to do? Im having a real hard time with all of this and everytime i think ok im going to get my life back im proved wrong. Personal note ( i could not work for the first 3 years due to taking care of my two disabled sons and teams of therapists and doctors on a weekly basis.) What do i do? I never lied or obtained false benefits, and they want me to lie and pay money that i dont owe.

    Its all about a corrupt town where they do what they want and try to threaten and scare people into making themselfs look guilty just so they will pay money to have it dismissed and done. Im not sure what to do or who to speak with? Its to the point to where my life has been shattered and my name ruined all because i didnt want to lie and refuse to pay anything that i dont owe or admit to something i didnt do. I dont know how much longer i can keep doing this, like i said before. I am a mom of three, i go to bed at 8:30 with my kids and try to live the way im supposed to. Please send any advise on what i should do or who to contact to recieve help, because all the lawyers around the surrounding counties are tied in with the judge.

    I would suggest that you and your family move to a new area, far away from your current area, and get new identities. This situation will not get any better.

    If this just isn't a little episode of "justified." It sounds to me as though Food Stamp fraud is by far one of the very smallest of smallest of problems this person has.

    That's horrible advice. Why do you constantly get on here and give out the worst advice ever to people?

    Why is this horrible advice? People who experience similar things in other countries, come to the United States for refuge and take on new identities. So, if they experience these things in one part of the United States, then they should move to a different part of the United States.

    What would you have this woman do, spend the rest of her life fighting the legal system?

    So people in other countries experience SNAP fraud? Really? That's why refugees come to the US? Are you pretending to be this stupid and ignorant or is it real? Refugees do not come here for what this person is posting about. Not even close. They come here to escape from far more hellish circumstances.

    If she leaves and makes a new identity she's going to be adding even more legal issues to her situation. We don't even know the whole story just her side.
