    Default What Happens to Life Insurance if the Beneficiary Dies

    Under New York law, if you are the beneficiary of somebody's life insurance policy, what happens if you pass away? Will the proceeds of the policy go to your spouse or estate?

    If the beneficiary passes away after the insured, the insurance proceeds will go to the beneficiary's heirs.

    If the beneficiary passes away before the insured, then the proceeds will go to a successor beneficiary (if any) and would otherwise normally go to the insured person's estate.
