    Default How Can Tenants Make an Unwanted Guest Leave their Apartment

    My question involves landlord-tenant law in the State of: Ohio

    I am currently on a month-to-month lease with my boyfriend for an apartment. Both of us are equal tenants on the lease.

    His brother was basically dropped off on our doorstep with hardly a day's notice with nowhere else to go so we allowed him to stay for a short time. However, he absolutely refuses to leave.

    We have never accepted money for rent or utilities or for any other reason. He is not listed on the lease in any form and has never received any mail at our address. There is no written agreement between him and us. It has been over a year with him in the unit and we ask for reasonable move out dates but are never given real answers. It is also hard to take any sort of action because he has shown to have an explosive temper and can become violent.

    There's not much we can do because of the risk of the apartment being destroyed by a violent tantrum and there is little to no civility on his part anymore.

    We also cannot simply give our own 30-day notice for move out at this time due to the added financial responsibilty of supporting another adult's utility and grocery intake.

    Do we as legal tenants actually have any say in his overstayed welcome or do we have to involve our landlord at this point? And can our landlord remove him in any fashion while he is not on the lease or must he take legal action against us, the actual paying tenants? (I.e. sadly eviction).

    Consider asking the local police if they will assist with his removal as a trespasser, or if they would compel you to allow him to move back in if you change the locks (with your landlord's permission), or if they will require an order of eviction before they help or decline to order that you restore his access.

    A thirty day notice is a piece of paper. You can afford a piece of paper.
