    Default What Can You Do if You're Being Released Late from Weekend Jail

    My question involves criminal law for the state of: North Carolina

    Hi there everyone,

    I was sentenced to 14 days in jail and decided to do weekends instead of all 14 days at once. I'm supposed to report in at Friday at 6PM and I'm supposed to be let out Sunday at 6PM, but the jail keeps releasing me late, usually anywhere from 6:20-6:40. Are they allowed to do this? And if not, what can I do about it?

    Also, I've already tried talking to the staff at the jail, and of course they could care less. I even talked to the Corporal on duty and made him give me a written proof of what time I was let out but he could care less too.

    So the only problem is that they don’t release you at exactly 6:00 pm but instead 20-40 minutes later? As a practical matter there really isn't a whole lot you can do about that.

    Even like 5-10 minutes late wouldn't be a big deal, but it's annoying they are releasing me on avg 30 minutes late, I mean you add up all the time and it ends up being several hours. I feel if you were sentenced to X amount of time, that's how much you should do, they shouldn't be able to legally hold you for longer than what you have been sentenced by a court for. Technically that's kidnapping as they are holding you against your will, but of course I realize it's not a case worth fighting in court as the legal cost would outweigh the benefit. And it especially annoys me because they require you be exactly on time or earlier, if you come in at 6:02, they will turn you away for being late, but yet they feel it is ok to let you out whenever they feel like.

    As mentioned, there is little that you can do from a legal standpoint. You can try and complain to someone above the on-duty supervisor, but, as a practical matter jails do not run like trains and processes are often subject to delays for a host of reasons.
