    Exclamation Can a Landlord Fix Something and Make You Pay for It Afterward

    My question involves landlord-tenant law in the State of: California

    So basically when we moved in the landlord had just installed a new shower. Recently the shower was clogged and we told her. She then hired her own plumber to come fix it and they said it was just hair and after it was done she said that we owed her $269 for it. Can she do that?

    I just feel like its unfair because we could've hired our own cheaper plumber but she didn't tell us we were having to pay for it until it was done.

    Please provide proof or specific laws against this if she is in the wrong because at this point we don't know what to tell her.

    The drain gets clogged, you called to complain about it, and a plumber comes and unclogs it. Since it was clogged due to no fault of the LL I'd say you're on the hook. It's not an issue of law, as you seem to want it to be, so much as contractual obligation. As the property belongs to the LL, the LL gets to authorize who can repair, it. If your lease states something differently then great, but I suspect it doesn't. You'll be ponying up the shekels for this one.

    Whose hair was it? The plumbers? The landlords?

    Nope...I'm guessing it was yours. You caused the clog. You requested a repair. The landlord responded with her plumber. It was found the clog was caused by you. You get to pay for it.

    This is even more clear since this was a new shower; not hair from previous tenants.

    Unless your landlord snuck in and stuffed her hair in your drain she is not responsible for the cost of removing the clog.
