    Default Can You Be Charged With a Probation Violation After the Probation Term Ends

    My question involves criminal law for the state of: Washington. I was put on probation for reckless driving January 22 2015 for 2 years. September 7th 2016 I was involved in a possible vehicular assault. My probation ended January 22 2017, yet I haven't been charged with anything from the September 7th incident. Is this a probation violation?

    Did you report the incident to your PO? If so, it's not a probation violation unless you're actually convicted of the crime. If you are eventually charged and convicted, they most certainly can charge you with the violation even though you are past your probation release date.

    Had nothing to report because I have not been charged with anything. Apparently the prosecutor in my city where the Sept 7th incident took place talked to the prosecutor in the other city where I was charged with the reckless. Got a notice in the mail saying I was in violation of my probation without being charged with anything yet. My probation is now up and no charges have still been filed

    Most probation conditions require you to report any interaction with the police whether you are charged or not. Does yours not have this provision?

    I did not have that provision. Basically, no traffic infractions. Which technically during the 2 years of my probation, I had zero infractions.

    Unless and until you are discharged from probation, you can still be charged with a probation violation. Once you are discharged, that will no longer be possible.

    You never had a provision to tell your PO if you broke the law?
