    Default How to Find Out if a Past I-130 Was Approved

    An immigrant believes that her I-130 was approved in 2005, when she was seventeen, but the National Visa Center says that the records of any approval have been destroyed. The I-130 was submitted by her U.S. Citizen stepfather. What can she do? Can she somehow recover that I-130 or does she have to start over?

    A petition for relative form (i-130I) becomes invalid after one year if no action is taken upon it, so the petition is no longer valid.

    Further, the immigrant is no longer a minor, and thus can no longer benefit from the immediate relative petition, so even if that weren't an issue the I-130 would no longer apply.

    Unfortunately, she will have to start over.
