    Default Roommate and Leasing Office Won't Let Me Break a Month-To-Month Lease

    My question involves landlord-tenant law in the State of: Virginia

    I live with three roommates. One is a roommate from hell. The other roommate and I want to leave and have given a written letter of notice to Management. Management says we can't leave unless Hell Roommate signs off on a lease termination document. Hell Roommate will not sign off on this out of spite as she is incensed that we are leaving. She also is refusing to meet with potential applicants to replace us as well, leaving us in a tough situation.

    The other roommate and I have already signed the lease termination letter and informed Management and the Hell Roommate we are leaving. Can we just leave?

    Without reading the actual lease agreement I can't say with any certainty but I'd just move out. It's month to month so head for the hills. That's one advantage of month to month...one of the few.

    Another roommate sob story.

    Sure, you can just leave.

    And face whatever consequences come your way, if any. And, no, I can't predict what they might be because I haven't read your rental contract.

    Chances are that your departure will force the remaining roommate to resign herself to signing off on the notice for her own protection.

    Are you on a signed lease that has been month to month all along or are you on a lease that has expired and is now month to month?
    What does your lease say about terminating your rental?
