    Default Can Your Employer Require That You're Always On Call

    If you're already working 40 hours per week, can an employer in the State of Virginia require that you always be on call to deal with issues when you're not at work, even in the middle of the night?

    Unless you have an actual contract of employment (or union contract / collective bargaining agreement) that limits the employer's ability to do so, and as long as you are properly paid for your time, you can be placed on call 24 hours per day, 7 days per week, 365 days per year.
