    The person who is liable for the damage is the client. If the employer wants to replace the phone as gesture of kindness to the employee it may do so, but it is not required to do so.

    The employee may have insurance coverage for the damage. The employee may make a restitution request as part of the criminal prosecution. The employee may also consider suing the client in small claims court.
