    Default How to Sell a Car When the Co-Owner is Deceased

    My question involves vehicle registration or title in the state of: texas. On the texas car title there are two names. I'm wanting to sell vehicle but one the person's on title is deceased. What do I have to do to sell or even sign title to new owner

    I'm not familiar with texas titles so a few questions if you will;

    is there an "and" or an "or" between the names?

    does the title say anything about rights of survivorship on it?

    And an issue seperate from the titled owners;
    is there a lien noted on the title?

    Was a document like this completed;

    http://www.txdmv.gov/txdmv-forms/doc...-motor-vehicle

    from what I can ascertain, if that form was completed, the ownership was jointly with rights of survivorship.

    I have to presume that if that form was not completed, there is no right of survivorship. That means the decedents 1/2 interest belongs to some heir of the decedent. That would mean you couldn't sell it without their inclusion in the sale.

    So are you saying the mother has now passed?

    if the car was the child's inheritance, why was the mother's name on the title?

    that didn't answer the question of the form either but given the situation I presume it was not utilized. Would that be correct?
