    Default Conditional Job Offer Revoked

    I was offered conditional employment (city government) pending my passing of a polygraph and a psychological examination. I passed the polygraph exam and was scheduled for the psych exam which I also passed. The next week I had an interview with the director of the agency. He informed me that my admission to viewing porn (polygraph) at my previous employers was a big negative to him. I was never disciplined, reprimanded, or fired for that activity. Later that week, the hiring manager called me at home and inquired about the frequency of viewing porn at work. I told him very infrequently. He then asked me whether I viewed porn at home and if I had it on my computer. I answered yes. A few days later I was denied the job.

    Do I have any legal recourse?

    No! Viewing porn at home is not the real issue here. If I was your potential employer I would be concerned about your porn viewing while at work! That alone would have me reconsider hiring you. This employer did no wrong. You may feel (and possibly be right) that would have no impact on your work and it would not happen again but no one knows that for sure. You were not mistreated or misled.

    The conditional offer that I signed was based upon me passing both examinations. I passed them. Isn't revoking the offer a breach of contract?

    Post the entire document (leaving out personal info).

    Unfortunately, I do not have the document and I was not given a copy. I signed the document over 2 weeks ago and my memory of it is faint. I suppose the verbiage in the contract might allow them to revoke the offer for whatever reason. It was a city government job so I assume the document is similar in other cities. What's your best guess?

    However, it is not even remotely illegal to refuse to hire you because you were viewing porn at work for a previous employer.

    They could hire you as per the alleged contract and then fire you the following day because of the porn viewing and it would be perfectly legal. So why bother?

    Yes, I know it's within the employer's rights. I'm not disputing that fact. However, I signed a legal document that binds the employer and myself in a contract. For example, the salary which was agreed upon by both parties was stated in the document. I just cannot recall exactly what else was stated in the document. Perhaps I made it past the polygraph screening on a fluke but I passed it nonetheless. Their mistake could be my grounds for legal recourse. But without a copy of the document, I'm just making a WAG.

    We have not yet established that you have a binding contract. Few employees (percentage-wise) receive employment contracts unless they are unionized. Many employees receive offer letters that are signed by both parties. However, few if any offer letters actually meet the definition of a binding contract.
