    Default How to Find Out if You Have a Probation Violation Warrant

    My question involves criminal law for the state of: CA

    I pled out on an AWDW charge while in the military. I was transferred from the state of CA to another state while in the military. I went thru my PO to get all necessary paperwork done for the transfer. The state of CA did not require supervision after transferring. I went AWOL while in the military and have since handled that issue. I was pulled over the other day for a seatbelt violation and was informed that I had a warrant for assault in the state of CA(was in-state pickup only).

    My question is why do I have a warrant now. It's been quite awhile since I've been on probation (close to 25years). I have been pulled over a few times before and never informed of this and have had background checks done with nothing coming back on those either. I don't plan on visiting the state in the future. So what am I to do???

    You can see if you can determine if this is the same charge or not. It may be someone used your identity and there is a new charge. Were you still on probation when you went AWOL? Did you ever properly close out your probation?

    I was still on probation when I went AWOL , but the terms of my probation stated that I was to keep a job, which I did, not stay in the military. As far as properly closing out probation I have no idea. I was 18yo at the time and had never been in trouble before. I do know that I never finished paying my fines.

    If you didn't pay off your fines, you never finished your probation. Therein lies the problem. I don't know if going AWOL would be considered committing a crime for purposes the standard probation condition of don't commit any further crimes while on probation.

    You should probably engage an attorney in the jurisdiction where you had been tried. They might be able to look into the matter and advise you on what could be done. It would seem that your probation was violated for some reason, that means that you could go back to jail for the original offense - and there may be additional offenses pending as well.

    The warrant will not go away by ignoring it. It's presence could have long lasting effects on employment, loans, government assistance, and continued police contact. So, it might be best to get ahead of it.
