    Default Can an Employer Charge an Employee a Fee for Being a Smoker

    Is it legal for an employer to charge a $500 per year fee for being a smoker? The fee has nothing to do with health insurance premiums or surcharges, and employees already pay an increased health insurance premium if they are smokers.

    The only fees that an employer may impose upon smokers are those associated with a valid wellness program, as described here. If this is simply a fee they impose on smokers, with no relation to a wellness program, then it is improper.
