    Default Can an Employer Charge an Employee a Fee for Being a Smoker

    Is it legal for an employer to charge a $500 per year fee for being a smoker? The fee has nothing to do with health insurance premiums or surcharges, and employees already pay an increased health insurance premium if they are smokers.
