    Default Going Out of State While on Parole Without Permission

    My question involves criminal law for the state of: California
    So i got out of prison on high control on 7/7/15 and after doing good by working and going to school, and not having no problems what's or ever I got dropped down to the lowest level I can be on parole , and I only see my parole officer ones every other month, and I don't even have to go in every month to do my summary no more. So it's been so hard to get a decent job cause of my record and I was just told by my general manager cause of my diligence they are offering me a better position and pay at another branch in another state , and I have a few days to accept. So I told my PO if I can transfer my parole to another state for the reason In respect, and he said no. I don't know why he would say no if I'm supposed to get off of parole even earlier cause of my good behavior, and I'm supposed to get off of parole in 5 months, so I'm wondering if I was to leave to another state without telling my PO , can he find out that I left if I get pulled over? Since I'm on the lowest level of parole would it come out on the police computer data that I'm in parole? And can I get violated ? If so how long would I do in jail? Thanks so much for your help.

    Yes, if stopped by the police in some other state they CAN find out you are on parole. I cannot say that they WILL find out because it depends on what databases the agency searches when running people. Additionally, your PO here could find out about your absconding through other means and you might find yourself violated.

    As for how long you'd be in jail (prison, actually, since you'd end up going back to state prison), that depends on how much more time you have on your sentence.

    If you are in good standing and have reasonable justification for the move, probation/parole transfer is routline. If you violate the terms and are gotten caught (either because you get stopped as CDW describes above) or you PO just finds out you aren't living where you are supposed to be living, you can be violated and at that point your chance for transfer are slim.

    also, since the officer is now aware of your job opportunity requiring a move which he denied, he may be inclined to checkup on you just to make sure you didn't move behind his back.

    Not saying that for sure he's going to but for some reason he denied your move, so if you do move and he decides to check on you and finds you have moved anyway............... Game Over!

    One of two things must generally happen before parole can be transferred out of state. One, Parole must either decide that they no longer care to have direct supervision of the parolee and grant their permission to reside out of state (usually simply an early release from parole as they are no longer accepting supervision), or, they must receive agreement from the receiving state to take over the supervision role.

    It is rare that a parolee will be granted permission to go to another state with that state accepting responsibility as most states do not want this responsibility, much less desirous of accepting convicted felons who may well be in need of ongoing supervision. Probationers are a different animal as they are on county level supervision and may well be under much less scrutiny (particularly if on "court" or "informal" probation in CA).

    Why would you even bother to take the risk? Did you like prison? Do you want to go back? It's up to you. But you will likely get caught and will get violated. It depends how long your spend in jail or prison.
