    Default Can a Father Stop a Name Change Petition for His Children

    Several years after her divorce, a mother in Connecticut has filed a petition to change her children's surname from that of her ex-husband to her maiden name. The father opposes the petition. The mother says that the children want to use her name. What can the father do?

    The father may oppose the mother's petition. He may appear in court on the hearing date to argue against the name change, alone or with a lawyer. If he opposes the petition the mother will have to convince the court hearing her petition that the name change is in the best interest of the children.

    In some cases, the court hearing a contested name change petition for minor children will transfer the matter to the court that decided the custody case.
