    Default No Reply From Landlord After Security Deposit Demand Letter

    Hi,

    I sent a letter to my landlord asking for receipts for the charges she put in the sheet. She sent me a letter asking $250 more than my deposit($450) for things which were normal wear and tear. So I sent her a secutiry deposit demand letter asking for the receipts and refund the deposit after valid deductions. She didnt reply back yet. It has been more than 2 weeks. What should I do next?

    We just had a person called "Tennessee" post a Florida legal problem. Are we to infer that you're in California?

    The landlord has to give you an itemized statement within 21 days listing the amount of any deductions from the security deposit, with an explanation of the reasons for the deductions. The landlord need only send you receipts for amounts incurred. The landlord can instead, for example, indicate that employees did the work describing the hours spent and a reasonable hourly rate.

    If the repair is not being done by the landlord and cannot be reasonably completed within 21 days, or if no receipt will be available from the third party performing the repair within 21 days, the landlord may provide a good-faith estimate of the cost of repair. The estimate should be corrected and a new notice sent within 14 days of the competion of the work, or the landlord's obtaining invoices or receipts.

    If you can't resolve the dispute you can try to get the landlord to participate in mediation, or sue in small claims court.
