I have a two year employment agreement with an employer experiencing financial difficulties. The terms were cash incentive (25k) for accepting position. The agreement basically states that if I terminate employment prior to completing 2 years of employment I must pay back the 25K. I have had payroll checks bounce on multiple occasions. My child support, although deducted from my "check" has not be paid in a timely manner. This has hit my credit report. My question is: At what point am I justified in considering the agreement breached. Wouldn't there be implied conditions for my employer, ie timely payroll? What documentation would be required to protect myself should he take me to court??
