    Default What to Do if Your Spouse Won't Appear for Your Immigration Interview

    A man married a U.S. citizen and came to the U.S., and subsequently received a conditional Green Card. Their marriage has broken down and they no longer live together. The man has an interview scheduled on his permanent residency, and at present his wife won't talk to him at all and he has no expectation that she will appear for his interview. What should he do?

    The man should speak with an immigration lawyer about his options. If the USCIS accepts that his marriage was bona fide, he may still be able to maintain permanent residency, but he should be prepared to demonstrate that he entered into a valid marriage, in good faith -- that's going to be more difficult with his wife's refusal to participate.
