It is very possible for a person who is wanted on a warrant to be detained, if the warrant is known to the judge or prosecutor when that person appears in court. Given that this is a truancy charge where the mother was summoned to court, there is a good chance that the prosecutor will have checked the mother for warrants. The mother should take care of her warrant or, at a minimum, discuss her options with a criminal defense lawyer.
