If you file for Chapter 7 bankruptcy, and you have additional money garnished after the case is filed, what should you do?
If the garnishments occurred after the bankruptcy was filed, the estate should be able to recover the money. If the creditor was aware of the bankruptcy at the time of the garnishment, you can seek to have them held in contempt of court. If not, they may be willing to voluntarily return the money once they are aware of the bankruptcy and automatic stay, or it may be necessary to bring a motion in the bankruptcy court. You should speak to your bankruptcy lawyer about the garnishments.
