    Default Inheritance Rights When a Divorced Couple Never Finalized Property Division

    A couple in Louisiana divorced, but they never got a court order separating their property. Several years later the husband died. The mother believes that she is entitled to keep his entire estate. Are the children entitled to receive anything from his estate?

    As the parents were divorced, if the father died without a will, his one-half of the community property and his separate property would be inherited by his children. If there is a will dated after the divorce, the will governs distribution of those assets.
