    Default San Jose, California Photo Radar May Be On Its Way Out

    San Jose California's NASCOP photo radar system may be on the way out, and that is a good thing.

    I don't like unsafe speeding, but I really hate it when the authorities use illegal means to enforce the law - as they did in San Jose.

    What has amazed me for a long time is that the local media never said anything about the illegality of the Nascop program. Nor did the media (not even in today's article) reveal that the "Photo Radar Notification" the program mails out can be ignored - because it has not been filed with the court. (This is the same ruse that other CA cities use on red light camera tickets.)

    The lessons to be learned here: (1) We can't trust the authorities to obey the law, because they think they are above it. But we already kinda knew that. (2) We can't trust the media to report about the authorities' tramplings of the law, if the illicit program is one the publisher thinks is "popular." Don't wanna upset any of those precious subscribers, ya know..

    Don't cheer too much, yet. Photo radar programs are being tested in several jurisdictions for possible employment state wide in a manner similar to those for red light cameras. It is also likely that the laws will change some time down the road to actually hold the registered owner of a vehicle liable in some way for the violations.

    In those "several jurisdictions" where they're thinking about using photo radar, the voting populace (those with brains) needs to let the politicians know that they're thinking about voting for someone else.

    As Patrick Bedard said, at the end of his July 2006 column in Car and Driver (if you want to see it Google his name and "Redflex"),

    "Think of Redflex as a commercial fishing company."

    "So what should we fish think when the fisherman insists we have a problem only he can solve? We should think it’s about the money."

    Well, those same jurisdictions already have red light cameras ... chances are the radar cameras will not be far behind and will not result in any massive uprising. By and large, most communities have broad support for red light cameras, I doubt this will change for radar cameras. Additionally, the radar cameras are restricted (so far) in the places where they may be deployed.
